Crosby Tech Corporation and its subsidiaries (“Crosby Tech,” “we,” “our” or “us”) is committed to protecting your privacy and the privacy of those who use our Products and Services. This Privacy Policy establishes the information we collect through our website (“Site”) and the Products and Services we provide to you, how we will use the information collected, and with whom we might share your information.

Capitalized terms that are not defined in this Privacy Policy shall have the meaning given to them in the Crosby Tech Corporation Terms of Service (“Terms of Service”) as in effect from time to time.

1              How We Collect and Use Your Information

Generally, in this Privacy Policy, the term "Personal Information" means any information relating to an identified or identifiable natural person; an identifiable person is one who can be identified, directly or indirectly, in particular by reference to a name, an identification number, or, in certain circumstances, Location Information, an IP address or the unique identifier allocated to a certain device. Specifically, we collect the information set forth below in Section 1.1 through Section 1.5 from you, which may include Personal Information.

Failure to provide necessary Personal Information when requested may result in you not being able to fully utilize the Service.

1.1          Contact Information

When you place an order on our Site, you must provide an email address, a first and last name, and a shipping address. In some cases, we may also require your phone number.

1.2          Payment and Commercial Information

To complete your order on our Site, you must provide payment information, such as your credit card or PayPal account. This payment information is needed in order to process your order and is not stored on our servers.  We also collect and store commercial information related to your orders, including records of the products or services you purchased.

1.3          User Account and Profile Information

You may update your User profile and account information when you log in to our Site or on our app.  This may include naming your device and uploading a profile picture, along with other Personal Information that you may choose to provide.[1]

1.4          Location Information

In order for the Service to work, it is necessary to collect data about your location. We use the term “Location Information” to refer to the combined location data made up of the location data available from: the Product (the Crosby tracking device you receive with our Service); the mobile phone or other device you use with our Service; and access of our Site as explained below.

In your account, you can also set and save favorite locations on a map and name these favorite locations. Crosby Users can choose to set alerts for their favorite locations.

We use your Location Information to provide the Service and may use your Location Information to promote the Service or provide you with offers. Your Location Information can be retrieved by you in using our Service and is stored securely on our systems. Your Location Information is never shared with other Crosby Users. For more information on how your information can be shared, see Section 4 on “How We Use and Disclose Your Personal Information.” Location Information is archived for Crosby User's individual use, and is not archived for use in an aggregate format for statistical analysis.

Additionally, if you use a computer, mobile phone or other device to visit our Site or help center, we use the IP address of that computer, mobile phone or other device to determine an approximate location. We do this so that we can provide you with a better, more personal customer service experience.

1.5          Children’s Information

In accordance with our Terms of Service, our Products and Services are intended to be used by adults over the legal age of 18.  Use of a Product or Service by any person under the age of 18 must be with adult supervision and the legal consent of such person’s parent or legal guardian adult.  Consistent with the Terms of Service, a Crosby User’s account registration must be by an adult over the age of 18.  With the verified consent from a parent or legal guardian adult, we may collect and use Personal Information of persons under the age of 18 consistent with this Privacy Policy. For information regarding accessing, modifying, rectifying or deleting your Personal Information, see Section 5.

1.6          Product Information

Our Products contain a SIM card in the tracking device to transmit Location Information. Each SIM card has a unique identifier that is tied to a specific Crosby User’s account.[2]

1.7          Mobile Application Information

We track how and how often you use the Service. We also collect certain information that your mobile phone or other device sends when you use it in connection with the Service. This includes information such as your email and the dates and times of your requests. We use this information to provide you with optimal services and support.

1.8          Information Collected Through Our Support Service

We provide support services through our Site, such as email request submissions when you contact us through the “Contact us” portal on our Site, recorded outbound telephone calls, and direct email. We collect any Personal Information you may choose to provide to our customer care team in the process. This includes, but is not limited to: your name, email address, phone number, and mailing address. We may use and process your Personal Information, including Location Information, to handle your support request and provide you with the best support possible.

2              Use of Cookies

2.1          What are Cookies?

Cookies are small text files that are placed on your computer’s hard drive or onto your mobile phone or other device’s memory if your browser is set to accept cookies. Like many other online services, cookies and other tools like them help us collect and understand how you use the Service.

Although most internet browsers automatically accept cookies, you can change your settings or use third-party tools to prompt you before accepting cookies from the websites you choose to visit, or to refuse cookies altogether. You can even delete them through your browser. Most browsers also have settings to prevent them from accepting new cookies, to notify you when you receive a new cookie, or to delete or disable cookies altogether. Some parts of the Service may not work for you as intended if you disable cookies.

2.2          How Crosby Uses Cookies

We use cookie technology in various ways to help make it easier for you to use the Service. For example, we use cookies to remember you when you return to our Site, identify you when you sign-in, authenticate your access, keep track of your in-app specified preferences or choices, tailor content to your geographic region, display a personalized browsing history, and/or to provide specific technical support.

We may also use cookies to gauge site usage and conduct research and diagnostics to improve the content we provide you, our Products and the Service, and to help us analyze general web traffic.

The cookies we use are provided by third parties and expire after they have fulfilled their purpose. Some cookies expire when you close your browser (i.e., session cookies) or after a set time period (i.e., persistent cookies). The expiration time of cookies that are placed by third parties (explained below) is determined by the third party, not us.

3              Third-Party Data Collection

Crosby uses various third-party service providers. We may share your information with third parties who provide services to Crosby, including helping us support, improve, promote and/or secure our Services or Products, processing payments, or fulfilling orders.

These third-party service providers may also place cookies on your computer’s hard drive or your mobile phone or other device’s memory or use web beacons to collect or receive information from the Service and elsewhere on the internet and use that information to provide analytics and to target ads. The information practices of these outside services are not covered by this Privacy Policy. We cannot access, nor do we have any control over, the cookies or other web technologies they may use.

3.1          Crosby has No Control Over Third-Party Content

The Service may contain links to websites and services that are owned or operated by third parties (each, a “Third-party Service”). Any information that you provide on or to a Third-party Service, or that is collected by a Third-party Service, is provided directly to the owner or operator of the Third-party Service and is subject to the owner’s or operator’s privacy policy. We are not responsible for the content, privacy or security practices and policies of any Third-party Service. To protect your information, we recommend that you carefully review the privacy policies of all Third-party Services that you access.

4              How We Use and Disclose Your Personal Information

We may use your Personal Information and Location Information to provide you with a better service, improve the quality of our Products and Service, and promote the Service. We use and process your Personal Information and Location Information to create anonymous, statistical and aggregated data reports where individual Crosby Users are not identified. The specific purposes for our acquisition, holding, use, and processing of your Personal Information include:

·       Providing Products, Services, or information that is requested and process payments;

·       Providing support related to our Service or Product;

·       Improving Crosby’s quality of the Service or Product;

·       Marketing the Service or Product; and

·       Research and development.

We do not sell your Personal Information to third parties.

Under applicable law, you may have the right to object to and opt out of certain uses and disclosures of your Personal Information. Where you have consented to Crosby’s processing of your Personal Information, you may withdraw that consent at any time and opt out of further processing by contacting support@crosbytech.io.

4.1          Disclosure of Your Information for Protection of Crosby or Others

We may use the information we collect, including Personal Information, to protect you and enforce our rights. For example, we may use and process your Personal Information and Location Information to prevent fraud, misappropriation, infringements, identity theft, and other illegal activities and misuse of the Service.

Like other companies, we may disclose your information to government or law enforcement officials or private parties as we, in our sole discretion, believe is necessary to: (i) comply with a law, regulation, or legal request; (ii) protect the safety of any person; (iii) address potential violations of our Privacy Policy or Terms of Service; (iv) investigate fraud, security, or technical issues; or (v) protect Crosby’s rights or property, our employees, customers and the public.

In addition, if we are acquired by a third-party as a result of a transaction such as a merger, acquisition or asset sale or if our assets are acquired by a third-party, or in the event we go out of business or enter bankruptcy, some or all of our assets - including any Personal Information collected from or about you - may be disclosed or transferred to a third-party acquirer in connection with the transaction.

5              Access, Modification, and Rectification of Your Information

You can access and modify your contact information, such as your name, email address or phone number, within the Service, or by contacting us at support@crosbytech.io. Where otherwise permitted by applicable law, you may send an email or use any of the methods set out in this Privacy Policy to request access to, receive (port), seek rectification, or request erasure of Personal Information held about you by Crosby. Please include your full name, email address associated with your account, and a detailed description of your data request. Such requests will be processed in accordance with applicable laws.

Under applicable law, you may also inquire as to whether Crosby is processing Personal Information about you, request access to your Personal Information, and ask that we correct, amend or delete your Personal Information where it is inaccurate or has been processed in violation of such applicable law.

Although Crosby makes good faith efforts to provide individuals with access to their Personal Information, there may be circumstances in which Crosby is unable to provide access and is not legally obligated to do so, including (depending on applicable law) but not limited to: where the information contains legal privilege, would compromise others’ privacy or other rights, where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question or where it is commercially proprietary. If Crosby determines that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. To protect your privacy, Crosby will take commercially reasonable steps to verify your identity before granting access to or making any changes to your Personal Information.

As a Crosby User, you may log into your account to view and access your Personal Information, including current Location Information within the Service. Please note, however, that the Location Information associated with your account is a core part of the Service and you will not be able to modify it. However, if you do not want us to use your Location Information, you can delete it by deleting your account using the process set forth in Section 5.1 below.

5.1          Information Deletion

If you want us to delete your Personal Information, Location Information and your account, please contact us at support@crosbytech.io with your request. We will take steps to delete your information as soon as we can, but some information may remain in archived/backup copies for our records or as otherwise required by law.

6              Communications from Us

If you receive an unwanted email or marketing communication from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. We will process your request within a reasonable time after receipt and within timeframes required by law. If you want to no longer receive communications from us, please contact us at support@crosbytech.io. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding Crosby and the Service and you will not be able to opt out of those communications (e.g., communications regarding updates to our Terms of Service or this Privacy Policy).

7              Security of Your Information

We implement various systems, applications and procedures to secure your Personal Information, to reduce the risks of theft, damage, loss of information, or unauthorized access, disclosure, modification or use of information. Please be aware, however, that these measures cannot absolutely guarantee the security of your Personal Information. Therefore, although we take great efforts to protect your Personal Information, we cannot guarantee and you cannot reasonably expect that our databases will be immune from any wrongdoings, malfunctions, unlawful interceptions or access, or other kinds of abuse and misuse.

7.1          You are Responsible for the Confidentiality of Your Account Information

You are responsible for keeping the secrecy of your password at all times. We recommend using a strong password that you do not share with other services.

If you believe the security of your account has been compromised, please change your password immediately via our Site or through our app. You can also contact us at support@crosbytech.io for assistance.

You are responsible for ensuring the email address associated with your account is accurate. We use that email address to contact you about service updates, changes to our policies, and account activities such as requests for your information or locate attempts on your device. Crosby is not responsible for Personal Information or data transmitted to a third party as a result of a Crosby User providing an incorrect email address.
